OVERVIEW

This website is operated by Cakewalk Chicago. Throughout the site, the terms “we,” “us,” and “our” refer to Cakewalk Chicago.

Cakewalk Chicago offers this website, including information, products, services, tools, custom products, classes, Personal Shopping, edible images, custom cutting, and other offerings, subject to your acceptance of these Terms of Service and any additional policies or terms referenced on this website.

By visiting our website or purchasing a product or service from us, you agree to these Terms of Service and to any additional policies, product terms, service terms, or notices incorporated by reference.

If you do not agree to these Terms, you may not use the website or purchase products or services through it.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which we offer products and services.

1. ONLINE STORE TERMS

By using this website, you represent that you are legally able to enter into a purchase transaction in your jurisdiction or that you have permission to allow a minor under your responsibility to use the website.

You may not use our website, products, services, customer-submitted content tools, or ordering systems for unlawful, fraudulent, abusive, infringing, or unauthorized purposes.

You may not transmit malware, viruses, harmful code, or other material intended to interfere with the operation of our website or systems.

We may suspend or terminate access to our services when these Terms are violated.

2. GENERAL CONDITIONS

We reserve the right to refuse, decline, limit, cancel, or discontinue service or an order when necessary for legitimate business reasons, including:

  • inventory limitations

  • production limitations

  • suspected fraud

  • abusive, threatening, or disruptive conduct

  • misuse of our services

  • safety concerns

  • payment problems

  • technical errors

  • inaccurate order information

  • violations of these Terms

  • circumstances that make an order impractical or impossible to fulfill

Any exercise of this right remains subject to applicable law.

We may limit quantities, services, or ordering access for an individual customer, household, account, payment method, or address when reasonably necessary.

You may not reproduce, duplicate, resell, exploit, or commercially use any portion of this website or Cakewalk Chicago service without our written permission.

3. PRODUCT INFORMATION, INVENTORY AND AVAILABILITY

Cakewalk Chicago is a specialty retail store with inventory that changes regularly.

Our complete in-store inventory is not necessarily displayed online.

Products shown online do not guarantee current in-store availability unless the website expressly states otherwise.

We do not guarantee that every product, size, color, brand, package, style, or quantity will remain available.

Product descriptions, packaging, ingredients, manufacturer specifications, colors, dimensions, or other details may change over time.

We make reasonable efforts to keep website information accurate and current. However, inventory, packaging, pricing, availability, specifications, services, and other information may occasionally become outdated or contain errors.

We reserve the right to correct errors, update information, change pricing, limit quantities, discontinue products, or cancel affected orders as permitted by law.

4. PRODUCT AND ILLUSTRATIVE IMAGES

Images appearing on the Cakewalk Chicago website may include:

  • actual product photographs

  • edited photographs

  • manufacturer images

  • digital renderings

  • mockups

  • illustrative graphics

  • AI-assisted images

  • AI-generated images

Some images are used to illustrate a service, product category, shopping situation, or general product type rather than the exact item that will be purchased.

Illustrative images may not depict the exact:

  • brand

  • packaging

  • size

  • quantity

  • color

  • configuration

  • product

  • inventory currently available

When an image is illustrative, the written product description, selected options, specifications, invoice, and confirmed order details control the purchase.

We make reasonable efforts to present colors accurately, but display settings, photography, lighting, digital rendering, and manufacturing variation may affect appearance.

Nothing in an illustrative image should be interpreted as a guarantee that every pictured item is currently in stock.

5. PRICES AND CHANGES

Prices for products and services may change without notice.

We may modify or discontinue products, services, classes, promotions, custom offerings, or website features at any time.

An incorrect price caused by a typographical, technical, system, or data-entry error does not obligate Cakewalk Chicago to sell the affected product or service at that incorrect price.

If an error affects an order, we may correct the error or cancel the affected transaction and issue any refund required by applicable law.

6. ORDERS AND PAYMENT

We reserve the right to accept, decline, limit, or cancel an order.

Customers are responsible for providing accurate:

  • name

  • email address

  • telephone number

  • billing information

  • pickup information

  • product selections

  • quantities

  • custom-order details

Payment must be completed according to the terms presented at checkout or on an invoice.

An order is not considered fully paid until Cakewalk Chicago receives confirmed payment.

Merchandise will not be released when payment remains outstanding.

If someone other than the purchaser is picking up an order, the customer is responsible for providing accurate pickup instructions.

7. ALL SALES FINAL

Except where required by applicable law or where Cakewalk Chicago determines that an order error, defect, damage, or fulfillment issue requires correction, all sales are final.

Cakewalk Chicago does not accept returns or exchanges for:

  • change of mind

  • incorrect customer selection

  • incorrect size or quantity selected by the customer

  • edible products

  • opened food-related products

  • edible images

  • personalized products

  • custom cuts

  • custom-fabricated products

  • special orders

  • clearance or sale merchandise

  • completed services

  • Personal Shopping fees

Additional details appear in our Refund Policy, which forms part of these Terms.

Customers should review the Refund Policy before purchasing.

8. EDIBLE PRODUCTS

Food products and consumable products are final sale.

This includes, where applicable:

  • edible colors

  • extracts

  • sprinkles

  • edible glitter

  • luster dust

  • fondant

  • icing-related products

  • edible decorations

  • edible images

  • other food or consumable products

Because of food-safety, contamination, storage, tampering, and quality-control concerns, these products cannot be returned or exchanged once sold except where required by law or where Cakewalk Chicago determines that the product was defective, damaged before release, incorrectly supplied, or otherwise requires correction.

9. CUSTOM AND PERSONALIZED PRODUCTS

Custom products are final sale.

This includes:

  • edible images

  • custom Cricut or machine cuts

  • personalized names or numbers

  • custom shapes

  • custom printed products

  • customer-specific designs

  • special orders

  • other items prepared specifically for a customer

Customers are responsible for reviewing and accurately submitting:

  • names

  • spelling

  • dates

  • dimensions

  • quantities

  • colors

  • images

  • files

  • wording

  • specifications

  • other customization instructions

Cakewalk Chicago is not responsible for reproducing an error that was contained in customer-submitted information or files.

Once work has begun, requested changes may not be possible and may require an additional charge.

10. CUSTOMER-SUBMITTED IMAGES AND CONTENT

By submitting an image, logo, photograph, artwork, design, text, graphic, file, trademark, character, or other content for printing, cutting, reproduction, customization, or use in an order, you represent that:

  • you own the content, or

  • you have permission, authorization, or another lawful basis to use and reproduce it for the requested purpose.

You are responsible for the content you submit and for ensuring that its use does not violate the rights of another person or organization.

Cakewalk Chicago may decline a reproduction, printing, cutting, or customization request at its discretion when we reasonably believe the request may be unlawful, infringing, unsafe, inappropriate, or inconsistent with our business policies.

Submission of content does not transfer ownership of that content to Cakewalk Chicago.

11. PERSONAL SHOPPING SERVICE

Cakewalk Chicago Personal Shopping is a paid convenience service intended for customers who are already familiar with our store and know what products they want us to locate.

The Personal Shopping fee compensates Cakewalk Chicago staff for work that may include:

  • checking in-store availability

  • physically locating products

  • pulling merchandise

  • making substitutions authorized by the customer

  • organizing the order

  • preparing merchandise for pickup

  • creating the merchandise invoice

The Personal Shopping fee is separate from merchandise charges.

The Personal Shopping fee is not a merchandise deposit or merchandise credit.

Once submitted, the Personal Shopping service fee is nonrefundable, even if some or all requested merchandise is unavailable, because staff time is spent performing the requested shopping and inventory-checking service.

Merchandise located through Personal Shopping is invoiced separately.

The customer must review and pay the merchandise invoice before the merchandise can be released.

Additional Personal Shopping terms displayed on the product page, including limits, substitution rules, pickup procedures, preparation windows, required acknowledgments, and other service conditions, are incorporated into these Terms.

12. PERSONAL SHOPPING SUBSTITUTIONS

Customers using Personal Shopping must select one of the substitution options made available at the time of purchase.

Cakewalk Chicago staff will not pause a Personal Shopping order to conduct repeated phone, email, or text negotiations over unavailable products.

When comparable substitutions are authorized, staff may use reasonable judgment in selecting an alternative.

When substitutions are not authorized, unavailable items will be omitted from the merchandise invoice.

13. MERCHANDISE PURCHASED THROUGH PERSONAL SHOPPING

After Cakewalk Chicago completes the shopping portion of the service, the customer will receive a separate invoice listing the merchandise available for purchase.

Customers are responsible for reviewing that invoice before paying.

Payment of the merchandise invoice confirms acceptance of the listed products, quantities, and charges.

Once the merchandise invoice is paid, the merchandise is final sale except where applicable law or Cakewalk Chicago’s error-correction policy requires otherwise.

14. THIRD-PARTY PICKUP, UBER AND COURIERS

Customers may authorize another person, delivery driver, Uber driver, courier, employee, family member, or other representative to pick up a completed order when that option is available.

Once Cakewalk Chicago releases an order to the person or third-party pickup provider designated by the customer, responsibility for transportation, handling, delay, loss, temperature exposure, damage, or delivery generally passes to the customer, except to the extent otherwise required by law.

Cakewalk Chicago is not responsible for the acts, delays, errors, cancellations, fees, or handling practices of an independent third-party transportation provider selected by the customer.

Delivery or courier fees are separate from Cakewalk Chicago merchandise and service charges unless expressly stated otherwise.

15. PICKUP AND ORDER RELEASE

Orders will not be released until required payment is complete.

Customers are responsible for providing accurate pickup information.

Cakewalk Chicago may request identifying information or order information before releasing an order.

Customers should inspect their purchase promptly after receiving it and report any suspected Cakewalk Chicago fulfillment error, incorrect item, or pre-existing damage as soon as reasonably possible.

16. DAMAGED, DEFECTIVE OR INCORRECT ITEMS

Final sale does not mean Cakewalk Chicago ignores its own mistakes.

If Cakewalk Chicago provides the wrong item, provides an item that was defective or damaged before release, charges incorrectly, or cannot provide merchandise that has already been paid for, contact us promptly.

We will review the circumstances and, where appropriate, may:

  • correct the order

  • replace an item

  • correct the charge

  • issue a refund for unavailable merchandise

  • provide another appropriate remedy

Any remedy will depend on the circumstances and applicable law.

Nothing in these Terms limits rights or remedies that are available under applicable law and cannot legally be waived.

17. CLASSES, EVENTS AND OTHER SERVICES

Classes, events, educational services, workshops, or other service-based offerings may have their own:

  • cancellation terms

  • rescheduling terms

  • attendance requirements

  • age requirements

  • preparation requirements

  • payment terms

When a product or service page contains specific terms, those specific terms supplement these Terms.

If a specific service policy conflicts with a general provision here, the more specific service policy will control to the extent permitted by law.

18. THIRD-PARTY TOOLS AND LINKS

The website may provide access to third-party platforms, payment systems, applications, social networks, courier services, mapping systems, or other tools.

Cakewalk Chicago does not control the operation or policies of independent third parties.

Use of third-party services may also be subject to that provider’s own terms and policies.

We are not responsible for independent third-party acts or omissions except where applicable law provides otherwise.

19. USER COMMENTS, REVIEWS AND SUBMISSIONS

If you submit reviews, comments, suggestions, feedback, or other material to Cakewalk Chicago, you represent that your submission is accurate and lawful.

You may not submit material that:

  • infringes intellectual-property rights

  • violates privacy or publicity rights

  • contains unlawful threats

  • contains malware

  • impersonates another person

  • is fraudulent or intentionally misleading

Cakewalk Chicago may moderate or remove website content where reasonably necessary.

20. ERRORS, INACCURACIES AND OMISSIONS

Occasionally our website, checkout, invoices, product descriptions, pricing, promotions, shipping information, availability information, service descriptions, or other materials may contain errors, inaccuracies, or omissions.

We reserve the right to:

  • correct errors

  • update information

  • change inaccurate information

  • correct pricing

  • cancel affected orders

We may do so even after an order has been submitted, subject to applicable law.

21. FRAUD, CHARGEBACKS AND PAYMENT DISPUTES

Customers agree to make reasonable efforts to contact Cakewalk Chicago regarding an order problem before initiating a payment dispute or chargeback.

Nothing in this provision eliminates any lawful chargeback or dispute right.

Cakewalk Chicago may provide payment processors, banks, card networks, Shopify, or other relevant parties with records related to a disputed transaction, including:

  • order information

  • product descriptions

  • customer acknowledgments

  • customization instructions

  • invoices

  • payment records

  • correspondence

  • pickup information

  • fulfillment records

Fraudulent payment disputes, false claims, or misuse of payment systems may result in cancellation of future orders or refusal of future service, subject to applicable law.

22. PRIVACY

Personal information submitted through the website is handled according to our Privacy Policy.

Customers should review the Privacy Policy for information regarding collection, use, storage, and disclosure of personal information.

23. ENTIRE AGREEMENT

These Terms, together with our Refund Policy, Privacy Policy, Shipping Policy, product-specific terms, service-specific terms, required acknowledgments, and other policies incorporated by reference, constitute the agreement governing use of the website and purchases through Cakewalk Chicago.

If Cakewalk Chicago does not immediately enforce a provision of these Terms, that does not mean the provision has been waived.

If a provision is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

24. GOVERNING LAW

These Terms and any separate agreements through which Cakewalk Chicago provides products or services are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles.

25. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in:

  • products

  • services

  • technology

  • business practices

  • legal requirements

  • Shopify functionality

The current version will be posted on this website.

Continued use of the website after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
